Immigration proceedings are matters of administration law, not criminal law. (As a result, the consequences of violating your immigration status is not jail but deportation.) And Congress has nearly full authority to regulate immigration without interference from the courts. Because immigration is considered a matter of national security and foreign policy, the Supreme Court has long held that immigration law is largely immune from judicial review. Congress can make rules for immigrants that would be unacceptable if applied to citizens.

In 1952's Harisiades v Shaguhnessy, Justice Felix Frankfurter wrote in his concurrence "One merely recognizes that the place to resist cruel and unjust legislation touching aliens is the Congress. not this court."

That being said, the Bill of Rights, applies to everyone, even illegal immigrants. So an immigrant legal or illegal, prosecuted under the criminal code has the right to due process.

Everything trump does about terrorist and immigration is what I call baiting.

He baits the hook. people don't see it.

If there are no terrorist here from those seven countries, he is baiting them to become terrorist. then in turn to say he was right. He's baiting illegals to make them criminals, by more than just crossing the border.
He does it with people, he does it with countries.
He's bating the news media and he's baiting the intelligence agencies. All done to solicit a responses, to be able to prove himself right.
People will ignore the fact, he's soliciting that response.

Trump chooses not to deal with the right thing first.

By not determining if any illegals are going to be able to stay and then describing who he going to deport. He is saying, but not saying, that all are subject to deportation. The decision of who's to stay must be made before the decision of who has to go.
In regards to Obamacare, he's getting rid of it, but no agreement on replacement.
Again, he need to have a replacement before getting rid of Obamacare. His talk doesn't matter, Get the replacement first and then repeal Obamacare is the way it's suppose to work. If he just talks, then one needs to realize it only about getting rid of Obamacare..
